Most people who file for disability are initially denied. Most people, even those that are obviously deserving are forced to appeal their denial and appear at a hearing before a judge. Disability Appeal – Generally speaking, there are four steps to a disability appeal. First is reconsideration. At reconsideration, we submit additional evidence and put together your case. Second, is a hearing with a judge. If you are denied at reconsideration (most people are) a judge hears your case at a live hearing. It is at this level that you or your attorney will stand up for your rights and put on the strongest case possible to show that you are disabled. The fourth step is federal court review. If the appeals council does not review your case or you disagree with the decision, your next step is to file suit in federal district court.
